1. Preamble and scope of application

HAPPY DAYS RECEPTION is committed to preserving the confidentiality of your personal information and attaches great importance to protecting the privacy of users of its services.

The purpose of the Privacy Policy is to define the applicable rules for the collection and processing of your personal information (hereinafter referred to as "Personal Data(s)") via our online site. Personal Data is defined as any information relating to a natural person that can be identified, directly or indirectly, such as the first and last names, email and postal addresses of a natural person, his image on a photograph or video, an IP address, a location data, a license plate, etc.

Our Privacy Policy details the Personal Data we collect and process through our online store, the reasons for processing your Personal Data, how we use them and the features we offer to allow you to access and update your Personal Data.

The Privacy Policy is an integral part of the General Terms and Conditions of Use and Sale of the website. It applies to users of our site regardless of their category: individual, non-professional, professional, candidate or recruiter.

Our Privacy Policy does not apply to services offered by third party companies, operating HAPPY DAYS RECEPTION partner websites or other websites accessible from our services. We are not responsible for how these sites use your Personal Data.

2. Acceptance and updating of our Privacy Policy 

By ticking the box "I have read and accept the Privacy Policy of the website" online, you (as a User) confirm that you have read and accept these terms and conditions without restriction or reservation.  If you disagree with any of its terms, you are free to stop using our services (in the event of a change in the terms of the Policy).

Our Privacy Policy may change, it being specified that any reduction in your rights cannot be applied without your consent. We will also publish the new versions of the Privacy Policy on and we will rely on you to review any changes to this Privacy and Data Protection Policy on a regular basis.

3. Person in charge of personal data processing

The processing of Personal Data of Users registered on the website is subject to French law, in particular to Law n° 78-17 of 6 January 1978 relating to data processing, files and freedoms, as amended (known as the law on Computing and Freedom) and to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 applicable from 25 May 2018 (known as the RGPD).

The "controller", as defined by the said Law, of the Personal Data of the Users of the site is : HAPPY DAYS RECEPTION - RCS Paris under number 52068502500048 - Address 22 avenue de la Grange Noire, 33700 Mérignac - France. The representative of the controller is Mr Eric VAN DE RIET.

In this capacity, we undertake, in the course of our activities, to comply with the provisions of the said Law, and to process your Personal Data lawfully, fairly and transparently. In particular, to process data for specified, explicit and legitimate purposes, without further processing incompatible with those purposes, for a period of time which does not exceed the period necessary for the purposes for which the data are collected and processed. 

4. Categories of Personal Data collected and processed via the website

a) Personal data that you provide to HAPPY DAYS RECEPTION

We collect Personal Data from web users who wish to: learn more about our activities (via the contact form), receive our news, apply for job offers posted on the website and buy products on our website (order forms).

The access and use of the website involves the collection and processing of your Personal Data, including, in particular, your first and last name, telephone number, e-mail and postal addresses, CV, photograph, etc. Some information is mandatory (followed by an asterisk) and others are optional as indicated in the form.

b) Cookies

A "cookie" (or "tracer") refers to a text file that may be stored in a dedicated space on your device's hard drive (computer, tablet, or smartphone) when you access a service that is accessible online.  A cookie allows its issuer to identify the device in which it is registered, during the period of validity or registration of the cookie. In the event that you refuse cookies or delete those stored on them, we inform you that you will not be able to benefit from a certain number of functionalities that are nevertheless necessary to navigate in some areas of our web site. If necessary, we decline all responsibility for the consequences related to the degraded functioning of our services resulting from the impossibility for us to record or consult the necessary cookies for their functioning and that you would have refused or deleted.

Finally, it is important to distinguish between the cookies we issue on our website and those issued by third parties. For this reason, please be aware that cookies may be placed from time to time on some pages of the website by third parties (advertisers or others). 5. Conditions of use of Personal Data

a) Purposes of the collection and processing of your Personal Data

Personal Data of Users are collected and processed only for the purposes defined in this article, namely: (i) Provide and manage our services; (ii) Manage the processing of your applications for Recruiters; (iii) Manage your product orders; (iv) Communicate with Users and improve the quality of our services, answer your questions and keep you informed of our news; (v) Fight online fraud; and (vi) Resolve any potential disputes or resolve any problems in the use of our services[AB1]. (vii) Candidate profiling to recommend content to improve the site experience. (viii) The generation of statistical reports and studies on the basis of anonymous data.

Any use of Personal Data for purposes other than those set out above in our Privacy Policy will require your express prior consent.

The legal basis for the collection of your Personal Data for the above purposes is your consent as provided for in Article 6-1-a of the European Regulation on Personal Data. This constitutes the expression of free, specific, enlightened and unambiguous will by which you accept, by the positive act of acceptance of this Privacy Policy, that Personal Data concerning you may be processed. In the case of minor candidates, the legal basis used is the consent of the legal representative of the person concerned.

As provided for in Article 7 of the GDPR, you may withdraw your consent at any time, without prejudice to the lawfulness of the processing operation based on your consent prior to its withdrawal.

b) How long your Personal Data will be kept

We undertake to keep your Personal Data only for the period strictly necessary for the processing operation(s) declared for the purposes above-mentioned and in any case within the limits imposed by the law. Also, depending on the type of Personal Data, the storage period may vary from a few days to several years.

In any event, we undertake to delete your Personal Data from our databases at the end of these different periods.

However, we may retain some information for a period after the closure of your personal account in order to comply with our legal, accounting and tax obligations and in particular, to prevent possible illegal behaviour after the deletion of your personal account (reuse of your old account by a third party). In this case, your data will be disabled and will not be accessible online.

6. Sharing information with third parties

a) Lack of communication to the third party

We undertake not to disclose to third parties any information and Personal Data you provide to us. This information and Personal Data is used exclusively by our internal services and will under no circumstances be transferred or sold to third parties without your express prior consent.

b) Communication for external processing needs

Your information and Personal Data may, if necessary, be transmitted to third party subcontractors involved in the provision of our services (technical and hosting service providers, customer follow-up and satisfaction surveys, security incident management or fraudulent activity, etc.).

HAPPY DAYS RECEPTION undertakes to communicate your information and Personal Data only to authorised and trusted service providers, who process them on our behalf, according to our instructions and in accordance with these Confidentiality Rules and in compliance with any other appropriate security and confidentiality measures.

c) Communication for legal reasons

In addition, your information and Personal Data may be disclosed to a third party if HAPPY DAYS RECEPTION is required to do so by law, a regulatory provision or a court order, or if this disclosure is necessary for the needs of an investigation, injunction or judicial procedure, within the national territory or abroad.

Similarly, we may share your information and Personal Data with companies, consultants or third parties in order to:

- Enforce the Privacy Policy and the General Terms and Conditions of the website in force, including to identify any breaches of them,

- To protect against any infringement of the rights, property or safety of HAPPY DAYS RECEPTION and its users, in accordance with the law.

d) Transfer of data outside the European Union

We do not transfer any Personal Data from our Users outside the European Union.

7. Personal Data Security

We implement all necessary security measures to protect your Personal Data from unauthorized access, disclosure, modification, damage or destruction of the data we hold.

To this end, HAPPY DAYS RECEPTION and its technical and hosting service providers have deployed appropriate measures to ensure the integrity, confidentiality and security of your Personal Data (in particular through compliance with ISO standards). However, we cannot ensure that your communications and other Personal Data will not be intercepted or disclosed by a third party.

We inform you that your Personal Data is stored on servers located in the European Union.

In order to contribute to the security of your Personal Data, please ensure that you choose a password that is sufficiently secure when you register on our Service. Under the Site's General Terms and Conditions of Use to which you have agreed, you are solely responsible for maintaining the confidentiality of your password and its use.

8. Respect of Users' rights on the website

You have a right of information and access (for example, to check the data we keep about you), a right of rectification and deletion (to update or correct your data), a right to limit the processing of personal data, a right to portability, a right of opposition, and a right to delete (for exemple, closing your personal account) your Personal Data, as well as a right not to be subject to an automated individual decision, including profiling.

In addition, it should be noted that these rights allow you to change your notification preferences at any time, by accepting or refusing that your Personal Data be used in the context of our marketing or promotional actions.

In the event of a dispute or disagreement, you have the right to file a complaint with a supervisory authority.
